Can a qualified bidder associated with another qualified bidder participate in the Auction?


Once parties are qualified to bid in the Auction, each qualified bidder will be asked in its Part 2 Application to make a number of certifications and each qualified bidder may be asked to provide additional information to the Auction Manager if these certifications cannot be made. In particular, each qualified bidder will be informed of the list of qualified bidders and will be asked to certify that it is not associated with any other qualified bidder. If a qualified bidder cannot make such a certification, it will be asked to identify associations it may have with other qualified bidders. If two qualified bidders are associated with one another, the Auction Manager will determine whether the two qualified bidders can both participate in the Auction on a case-by-case basis, as well as the terms and conditions of such participation (including the application of load caps).

The Auction Manager has provided a series of questions and answers regarding the Association and Confidential Information Rules that are posted to the Auction Rules page under the “bidder info” tab of the BGS Auction website. These questions and answers address a number of common situations, but do not contemplate all situations. The Auction Manager will consider all information provided by bidders with their Part 1 Application and Part 2 Application in determining whether bidders can participate in the Auction.
